These terms and conditions constitute a contract between borrowers (“Borrower”) who apply for loans through the webform on wwww.omicron.net.au (“Application”) and Omicron Mortgages P/L (“Omicron”).
The Borrower must at all times act in an honest fashion. In particular estimates as to the value of their property should not be aspirational but rather grounded and conservative, based on the opinions of real estate agents and realistice comparable sales. Failure to do this will result in forfeited application fees paid to lenders and brokers and wasted time. In some cases it may result in caveats being placed on your property.
The Borrower must not look to Omicron for any losses they incur as a result of an Application. While Omicron provides tools to assess the integrity and competence of accredited Lenders and Brokers the responsibility for dealing with such Lenders and Brokers is the Borrowers. Omicron disclaims all liability for the actions of its accredited Brokers and Lenders and for the appropriateness of having them registered to the platform. The software is designed to weed out bad eggs, not to prevent them from becoming registered in the first place. Therefore it is to be expected deficient Lenders and Brokers will make it onto the platform. Moreover the software may be flawed in design, concept or code, and it is anticipated that it will take many years to hone and perfect it. The Borrower acknowledges all this and and agrees to hold Omicron safe from losses incurred as a result of an Application.
